01Acceptance of these terms

By using this website or engaging Legado Creativo for any project, you confirm that you are at least 18 years old and that you have the authority to enter into these Terms, whether on your own behalf or on behalf of an organization you represent

02Our services

Legado Creativo provides brand strategy, graphic design, web design, and related creative services. The specific scope, deliverables, timeline, and fees for any project will be defined in a separate proposal, statement of work, or written agreement between you and Legado Creativo. In the event of a conflict, that project agreement takes precedence over these Terms for the work it covers

03Proposals, fees, and payment

Fees, payment schedules, and deposits are set out in each project proposal or agreement. Unless otherwise stated, invoices are due within the period specified in the applicable agreement. We may pause or suspend work on projects with overdue balances. Because we work with international clients, you are responsible for any taxes, currency conversion costs, or transfer fees that apply to your payments

04Client responsibilities

To help us deliver our work on time, you agree to:

• Provide accurate, complete information and any materials needed for the project
• Review deliverables and give feedback within reasonable, agreed timeframes
• Ensure you have the rights to any content, logos, images, or text you provide to us
• Make payments according to the agreed schedule

05Intellectual property

Any pre-existing materials, tools, and know-how that Legado Creativo uses to create your project remain our property. Upon full payment, final deliverables created specifically for you are transferred or licensed to you as described in your project agreement

Unless agreed otherwise, Legado Creativo retains the right to display completed work in our portfolio and marketing materials as an example of our services. Drafts, concepts, and unused designs remain the property of Legado Creativo

06Website content and license

All content on this website, including text, graphics, logos, images, and design, is owned by or licensed to Legado Creativo and is protected by intellectual property laws. You may view and use the website for your personal, non-commercial purposes only. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission

07Acceptable use

You agree not to use our website or Services to:

• Violate any applicable law or regulation

To the fullest extent permitted by law, Legado Creativo and its founder will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, data, or business, arising from your use of our website or Services. Our total liability for any claim relating to a project will not exceed the amount you paid to us for that specific project

12Indemnification

You agree to indemnify and hold harmless Legado Creativo, its founder, and its collaborators from any claims, damages, or expenses arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right, including in relation to content or materials you provide to us

13Termination

Either party may end a working relationship as described in the applicable project agreement. We may also suspend or terminate your access to our website at any time if you violate these Terms. Upon termination, any fees earned for work completed remain payable, and the sections of these Terms that by their nature should survive will continue to apply

14Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts and the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or our Services will be subject to the exclusive jurisdiction of the state and federal courts located in Boston, Massachusetts, unless otherwise required by applicable law in your country of residence

15Changes to these terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of our website or Services after changes take effect means you accept the revised Terms
